We are committed to protecting the privacy of every athlete, coach, and partner who uses the AVI Platform.

1Introduction

Athlete Valuation Group LLC (“Company,” “we,” “us,” or “our”) is committed to protecting your privacy. This Privacy Policy describes how we collect, use, disclose, and safeguard your information when you use the AVI Platform (“Platform”) accessible at www.myaviscore.com and related services. This Privacy Policy also serves as our notice at collection under the California Consumer Privacy Act.

Please read this policy carefully. By using the Platform, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with this Privacy Policy, you must not use the Platform.

This Privacy Policy applies to all users including athletes, sports agents, coaches, institutional subscribers, brand sponsors, and visitors.

2Information We Collect

2.1 Information You Provide Directly

When you register for an account or use the Platform, we may collect:

  • Identity information: full name, date of birth, true height, weight, position, and sport
  • Contact information: email address, phone number, and mailing address
  • Athletic performance data: statistics, measurables (standing vertical, shooting splits, combine metrics), academic standing, and eligibility status
  • Social media handles and follower counts across major platforms
  • High school, JUCO, or college institution affiliation and conference
  • Profile photos and media content you upload
  • Payment and billing information (for institutional subscribers)
  • Communications you send to us or through the Platform; and any other information you voluntarily provide, which may include sensitive personal information such as racial or ethnic origin, religious beliefs, or health-related data to the extent voluntarily disclosed in your profile

2.2 Information We Collect Automatically

When you use the Platform, we may automatically collect:

  • Device information: IP address, browser type, operating system, and device identifiers
  • Usage data: pages visited, features used, clicks, search queries, and session duration
  • Location data: general geographic location based on IP address
  • Cookies and tracking technologies (see Section 7)

2.3 Information From Third Parties

We may receive information about you from:

  • Public athletic databases, recruiting services, and media sources
  • Social media platforms (where permitted by your privacy settings)
  • Sports analytics providers and statistical databases (e.g., KenPom-based data sources)
  • Brand sponsors and partners who interact with your profile
  • Coaches, agents, or institutional users who reference your profile

3How We Use Your Information

3.1 Platform Operations

We use your information to:

  • Create, maintain, and display your athlete profile and AVI Score
  • Calculate and update your Athlete Valuation Index (AVI Score), including Performance Value and Commercial Value components
  • Operate the Sponsor Marketplace and facilitate connections between athletes and brands
  • Process institutional subscriptions and provide access to recruiting resources
  • Send transactional communications related to your account

3.2 Data Analytics and Licensing

A core function of the Platform is data analytics and licensing. We use your information to:

  • Generate aggregated, anonymized market intelligence reports for brand partners and institutional clients
  • License data insights (including demographic trends, valuation ranges, and performance benchmarks) to third-party brands, athletic apparel companies, sports agencies, and media organizations
  • Develop and improve our proprietary valuation algorithms and market positioning tools
Important

The Company retains ownership of all aggregated and platform-generated data, including all AVI Scores and derivative analytics. By creating a profile on the Platform, you grant the Company a perpetual, irrevocable, worldwide, royalty-free, sublicensable, and transferable license to use your data as described in this Privacy Policy and the Terms of Service. Athlete profiles are offered free of charge; the data license granted herein constitutes material consideration for such free access. This license survives account deletion or termination.

3.3 Ambassador and Marketing Programs

If you participate in an AVI ambassador or referral program, we may use your information to track program participation, calculate performance-based compensation, and coordinate promotional activities. Your participation in any ambassador program is governed by a separate ambassador agreement.

3.4 Legal and Compliance

We may use your information to comply with applicable law, respond to legal process, enforce our Terms of Service, protect the rights and safety of our users, and cooperate with regulatory authorities including NCAA compliance requirements.

4How We Share Your Information

4.1 With Brand Sponsors and Marketplace Partners

When you create a public athlete profile, certain profile information (name, school, position, sport, AVI Score range, and social media follower tiers) may be visible to brand sponsors participating in the Sponsor Marketplace. Detailed contact information is not shared without your explicit consent to initiate a partnership inquiry.

4.2 With Institutional Subscribers

Coaches, scouts, and recruiting personnel who hold institutional subscriptions (AVI 10 or AVI 25) may access your profile data as part of their recruiting and evaluation process. This use is designed to comply with NCAA Recruiting Services Provider Program (RSSP) requirements.

4.3 With Data Licensing Partners

We license aggregated and de-identified data to third-party partners including athletic brands, media companies, and sports agencies. We do not sell your individually identifiable personal information without your explicit written consent. For the avoidance of doubt, the disclosure of de-identified or aggregated data that cannot reasonably be used to identify a specific individual does not constitute a “sale” of personal information under applicable law. Data licensing is conducted pursuant to written data licensing agreements that require recipients to maintain appropriate safeguards.

4.4 Service Providers

We may share your information with trusted third-party service providers who assist us in operating the Platform, including cloud hosting providers, email delivery services, payment processors, and analytics tools. These providers are contractually obligated to protect your information and use it only for the services they provide to us.

4.5 Legal Requirements

We may disclose your information if required to do so by law or in response to a valid subpoena, court order, or government request, or to protect the rights, property, or safety of the Company, our users, or the public.

4.6 Business Transfers

In the event of a merger, acquisition, sale of assets, or financing transaction, your information may be transferred to the acquiring entity, subject to the same protections described in this Privacy Policy.

5Data Retention

We retain your personal information for as long as your account is active or as necessary to provide you with the Platform's services. If you request account deletion, we will remove your personally identifiable information within thirty (30) days, except where retention is required: (a) to comply with applicable law, regulation, or legal process; (b) to fulfill existing contractual data licensing obligations entered into prior to your deletion request; or (c) for legitimate business purposes such as fraud prevention and dispute resolution.

Aggregated and de-identified data derived from your profile may be retained indefinitely as part of the Company's proprietary data assets, as such data does not constitute personal information.

6Your Rights & Choices

6.1 Access and Correction

You may access and update your personal information at any time through your account settings. If you believe any information we hold about you is inaccurate, you may request a correction by contacting us at info@avindex.io.

6.2 Account Deletion

You may request deletion of your account by contacting info@avindex.io. Please note that deletion of your account does not automatically remove aggregated or anonymized data that has already been incorporated into our analytics or licensed to third parties.

6.3 Marketing Communications

You may opt out of promotional emails at any time by clicking the unsubscribe link in any promotional email or contacting us directly. You will continue to receive transactional messages related to your account.

6.4 Data Portability

Upon request, we will provide you with a copy of the personal data you have submitted to the Platform in a commonly used electronic format.

6.5 California Residents

California residents may have additional rights under the California Consumer Privacy Act (CCPA) / California Privacy Rights Act (CPRA), including: the right to know what personal information is collected and how it is used; the right to delete personal information; the right to correct inaccurate personal information; the right to opt out of the sale or sharing of personal information; the right to limit the use and disclosure of sensitive personal information; and the right to non-discrimination for exercising privacy rights.

6.7 Residents of Other States

Residents of Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and other states with comprehensive privacy laws may have similar rights to access, correct, delete, and opt out of the processing of personal data. To exercise any applicable rights, contact us at info@avindex.io. We will respond in accordance with the timeframes required by applicable state law.

6.8 NCAA Student-Athletes

If you are a current NCAA student-athlete, you are responsible for ensuring your use of the Platform and any data sharing complies with your institution's policies and applicable NCAA bylaws. Please consult your institution's athletics compliance office before using NIL-related features.

7Cookies & Tracking Technologies

The Platform uses cookies and similar tracking technologies to enhance your experience, analyze Platform usage, and support our operations. Types of cookies we may use include:

  • Essential cookies: Required for the Platform to function properly
  • Analytics cookies: Help us understand how users interact with the Platform (e.g., session duration, popular features)
  • Preference cookies: Remember your settings and preferences

Most browsers allow you to control cookies through your browser settings. Disabling certain cookies may affect the functionality of the Platform. The Platform does not currently respond to “Do Not Track” browser signals.

We may use third-party analytics services, such as Google Analytics, which may collect information about your use of the Platform. You may opt out of Google Analytics by installing the Google Analytics Opt-Out Browser Add-On.

8Security

We implement commercially reasonable technical and organizational measures to protect your personal information against unauthorized access, disclosure, alteration, or destruction. However, no method of transmission over the Internet or electronic storage is 100% secure. We cannot guarantee absolute security of your data.

In the event of a data breach that is likely to affect your rights or freedoms, we will notify affected users and relevant state authorities within the timeframes required by applicable law (generally not later than sixty (60) days after discovery of the breach, or sooner where required by state law). Such notification will include a description of the breach, the categories of information involved, and steps you can take to protect yourself.

9Children's Privacy

The Platform is not directed to children under 13 years of age. We do not knowingly collect personal information from children under 13. If we become aware that we have collected personal information from a child under 13, we will take steps to delete that information promptly.

Users between 13 and 17 years of age (“Minor Athletes”) may use the Platform only with verifiable parental or guardian consent obtained through a reasonable method designed to ensure the person providing consent is the minor's parent or guardian. We will obtain separate, affirmative parental consent before selling or sharing personal information of Minor Athletes or using their personal information for purposes other than those for which it was collected.

We implement additional safeguards for Minor Athlete accounts, including restricting direct brand contact through the Sponsor Marketplace unless a parent or guardian has separately authorized such communications. Parents or guardians may contact us at info@avindex.io to review, modify, or delete their child's information.

10Third-Party Links & Services

The Platform may contain links to third-party websites or integrate with third-party services (such as social media platforms). This Privacy Policy does not apply to those third-party services, and we are not responsible for their privacy practices. We encourage you to review the privacy policies of any third-party services you access through the Platform.

11Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we make material changes, we will notify you by updating the Effective Date at the top of this policy and by sending you an email notification at least fifteen (15) days before the changes take effect. Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the updated Privacy Policy.

If you do not agree with the revised Privacy Policy, you must discontinue use of the Platform before the changes take effect.
